Kang v. Coldata, Inc., C.A. No. C 01-04115 WHA (U.S.D.C., N.D. Cal.)

Ms. Caldwell is class counsel in this consumer class action brought pursuant to the Fair Debt Collection Practices Act on behalf of a class of California consumers. The action asserts that Coldata failed to provide the validation notice required by the FDCPA, and that two letters sent to plaintiff and the class were deceptive and misleading. Plaintiff obtained a default judgement against Coldata, Inc., and the district court denied defendant's motion to lift the default as to the claims of the representative plaintiff. Ms. Caldwell negotiated a settlement on behalf of the class, and it has been preliminarily approved by the Court.
